These Terms of Service (“Terms”) govern your use of the Berg Studio website and outline the general basis on which we work with clients. By using this site or engaging our services, you agree to these Terms. Specific project work is governed by the signed proposal or agreement for that engagement, which takes precedence over this page where the two differ.

Our Services

Berg Studio is a creative agency offering branding, digital design, web design and development, and related creative services. The scope, timeline, and cost of any project are defined in a separate proposal or agreement signed by both parties.

Use of This Website

This website is provided for informational purposes, to showcase our work, and to let prospective clients get in touch with us. You may not copy, reproduce, or repurpose the content on this site, including case studies, images, and written material, without our prior written permission.

Intellectual Property

Unless otherwise agreed in a signed client contract, all creative work, designs, and materials produced by Berg Studio remain our intellectual property until full payment has been received for the relevant project, at which point ownership transfers according to the terms of that agreement. All content on this website, including our name, logo, and Journal articles, is owned by Berg Studio.

Client Engagements and Proposals

Project work begins once a proposal or statement of work has been agreed and, where applicable, a deposit received. Any changes to project scope, timeline, or deliverables after that point are handled through a written change order, to keep expectations aligned on both sides.

Payment Terms

Payment terms, including deposits, milestones, and invoicing schedules, are set out in each project’s proposal or agreement. Unless otherwise stated, invoices are due within 14 days of receipt, and we reserve the right to pause work on overdue accounts.

Confidentiality

We treat information shared with us during a project as confidential, and we expect the same in return regarding our proposals, pricing, and internal processes. Either party may request a mutual non-disclosure agreement for particularly sensitive engagements.

Limitation of Liability

To the fullest extent permitted by law, Berg Studio is not liable for any indirect, incidental, or consequential damages arising from the use of this website or our services. Our total liability for any claim relating to a project is limited to the fees paid for that specific engagement.

Termination

Either party may terminate an ongoing engagement in line with the notice period set out in the relevant project agreement. We reserve the right to suspend access to this website for anyone who misuses it or violates these Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Berg Studio is registered, without regard to conflict of law principles.

Changes to These Terms

We may revise these Terms from time to time. Updates take effect as soon as they’re posted on this page, so we’d encourage checking back periodically.
